GENERAL TERMS AND CONDITIONS WITH CUSTOMER INFORMATION

1. Scope

By submitting an order, the customer agrees to accept the following general terms and conditions (hereinafter "GTC") in their entirety. The online sales contract for items is concluded between Sharon Hassell Care (siztaz.ch) and the customer. The customer declares that he or she is capable of doing business with Siztaz on the basis of the general terms and conditions available on the Siztaz.ch website. These general terms and conditions are decisive, even if other conditions are stated on our website.

2. Information on the website/offer/prices

2.1 Siztaz attaches great importance to providing customers with the most comprehensive and correct product information possible, which is presented in an easy-to-understand and clear manner on our website www.siztaz.ch. Some of this information is obtained directly from the manufacturers and carefully prepared. However, customers are strongly advised to consult the specific information in the packaging leaflet or the product information on the manufacturer's website. This information takes precedence over the information on siztaz.ch.

2.2 All information on the website www.siztaz.ch is provided without guarantee and Siztaz accepts no liability. To the extent permitted by law, Siztaz specifically excludes any warranty and liability for the accuracy, completeness and timeliness of the information on the website. This means that siztaz.ch does not guarantee that the information provided on the website is error-free, complete or up-to-date. It is the responsibility of the user to critically examine the information and, if necessary, to use other sources or information to ensure its accuracy and completeness. Siztaz.ch is not liable for any damage or loss that may arise as a result of using the information on the website.

2.3 The current prices are published on the website www.siztaz.ch.

2.4 All prices are quoted in Swiss francs (CHF) and include VAT unless otherwise stated.

2.5 In addition to the prices stated, shipping costs will be charged according to the prices stated on the “Shipping” page depending on the shipping method (A or B post).

2.6 We reserve the right to make changes to prices and product ranges. The images of all products and illustrations are for illustrative purposes only and may differ from the actual product. It is possible that the technical names of the products supplied may differ from the manufacturer's names or the information provided on the Internet.

2.7 The prices are binding for both parties at the time of the order. In the event of errors or mistakes in the price information, Siztaz reserves the right to make subsequent price changes. In such a case, the customer will be informed and is not obliged to purchase the affected products at the changed price.

3. Order and delivery:

3.1 The customer confirms his order bindingly by clicking the order button at the end of the ordering process on the page with the overall overview of the order.

3.2 Siztaz reserves the right to refuse an order, in particular if there is a legal dispute with the customer, for example due to unpaid orders with Siztaz or outstanding invoices from the same person or a person living in the same household.

3.3 It is the customer's responsibility to provide the delivery address completely and correctly. If the customer provides an incorrect delivery address, it may not be possible to deliver the goods. In such a case, Siztaz may decide to refuse delivery of the product entirely, without any right to compensation or damages.

4. Delivery and delivery period:

4.1 Siztaz ensures that the products are dispatched from its warehouse on the day of the order, in accordance with its dispatch policy. Orders received over the weekend will be dispatched on the next working day.

4.2 Siztaz can only be held liable for delays in delivery and their consequences if they are caused by gross negligence or intentional conduct on the part of Siztaz. Siztaz accepts no liability for other delays in delivery and their consequences, including delays caused by the post office, Siztaz's suppliers or third parties.

4.3 Siztaz does not deliver products to PO box addresses.

5. Products delivered in error:

If items are delivered in error or an excess quantity is delivered, they must be returned immediately in their original packaging, at the latest within 7 days. Items not returned within this period will be invoiced. The cost of returning the goods delivered in error will be borne by Siztaz. The return costs will be refunded to the customer in advance.

6. Shipping costs

When completing the order, the customer can choose between shipping by A-Post or B-Post. The shipping costs to be borne by the customer are CHF 6.00 per shipment for B-Post (PostPac Economy) and CHF 9.00 for A-Post (PostPac Priority).

7. Vouchers:

A maximum of one voucher (or discount code) can be redeemed per order. At the end of the ordering process, the voucher code is entered in the field provided. The corresponding amount is deducted directly from the total amount of the current order. Vouchers whose value exceeds the order amount cannot be refunded.

8. Right of withdrawal/right of return

8.1 Customers have the right to return the goods within 14 days of delivery of the goods. The right of return is exercised by returning the unopened goods, no justification is required. The return must be sent to:

8.2 Exercising the right of return will result in the purchase contract being converted into a rescission relationship, whereby the services received under the purchase contract must be refunded. The customer will bear the costs of the return shipment.

8.3 After receipt of the goods, any purchase price already paid will be refunded to the customer.

8.4 The right to deduct the purchase price to be refunded or to issue an invoice for possible damage or excessive wear and tear of the goods remains reserved. No deduction will be made if the loss in value is due to handling of the goods that is necessary to determine their type, quality and functionality. siztaz.ch may refuse to refund until it has received the goods back or until the customer has provided proof that he has returned the goods, whichever is earlier.

8.5 siztaz.ch guarantees that the products are undamaged at the time of shipment. Products that are damaged during shipment will be repaired or replaced at siztaz.ch's discretion, provided that the customer notifies siztaz.ch of the defect by email within 7 days of receipt of the goods. If siztaz.ch so requests, the customer must also immediately return the delivered products in their original packaging to siztaz.ch; siztaz.ch will cover the shipping costs.

siztaz.ch cannot guarantee that customers or siztaz.ch itself can successfully enforce claims against suppliers or the shipping service provider. In the event of transport damage, siztaz.ch cannot guarantee that claims against the shipping service provider can be successfully asserted.

In particular, siztaz.ch does not guarantee that the products are suitable for the use intended by the customer or that they will produce a specific result.

8.6. Returned products or packages will only be accepted in proper condition, i.e. unused, unopened, undamaged and in their original packaging .

9. Payment methods

We offer you different payment options on siztaz.ch:

Twint: Twint is a 100% branch of PostFinance and a fast, easy and secure payment method. Twint is a digital wallet that works with a free app for smartphones (iOS or Android). Twint works without a credit card or bank card, can be used with any postal or bank account and is independent of all telecom providers. Instead of carrying cash in your traditional wallet, simply top up your credit and then pay.

PostFinance (PostFinance Card or PostFinance E-Finance)

credit cards (Visa, Mastercard and American Express)

Wallee is a 100% secure payment method by credit card (Visa, Mastercard and American Express). The data you enter is encrypted using the SSL protocol before transmission. This means that we never have access to your data. When you pay by credit card, make sure that the URL begins with "https" and that a small lock is displayed on the right side of the screen. These two elements guarantee a 100% secure payment.

PayPal

PayPal is a simple, fast and secure payment method. PayPal is a virtual account that protects your bank details or credit card number. PayPal does not share your personal data with third parties. You do not enter your bank details or credit card number every time you make a purchase; your email and password are sufficient. Transactions are carried out immediately.

10. Data Protection
10.1 Siztaz.ch uses the data entrusted to it with respect for the customer (hereinafter referred to as the customer). Customer data is not sold, rented, loaned or passed on to third parties.
10.2 Under “My Account” the customer has the possibility to change his personal data at any time.

11 Contact

When you contact us (e.g. via contact form, email, telephone or via social media), the user's details will be processed to process the contact request and its handling in accordance with Art. 6 Paragraph 1 Letter b. (within the framework of contractual/pre-contractual relationships), Art. 6 Paragraph 1 Letter f. (other inquiries) GDPR. The user's details may be stored in a customer relationship management system ("CRM system") or comparable inquiry organization.
